Terms and Conditions

By visiting and/or purchasing tickets, you accept the General Terms and Conditions and the Visitor Rules of the Magic Bavaria Experience Museum.

1. Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of Magic Bavaria GmbH (hereinafter "Seller") apply to all contracts for the delivery of tickets concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the tickets presented in the Seller's online shop. The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise agreed.

1.2 These GTC apply accordingly to contracts for the delivery of vouchers, unless expressly stated otherwise.

1.3 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legally capable partnership who, when concluding a legal transaction, acts in the course of their commercial or self-employed professional activity.

1.4 These GTC solely govern the sale of tickets for specific events described in the Seller's product descriptions and not the actual implementation of these events. The implementation is governed exclusively by the legal relationship between the customer and the event organizer and possibly by differing conditions of the organizer. If the Seller is not also the event organizer, the Seller is not liable for the proper execution of the event.

2. Ticket Purchase / Contract Conclusion

2.1 Tickets for the Magic Bavaria Experience Museum can be purchased online or at the ticket counter during opening hours.

2.2 The online shop presentation does not constitute a legally binding offer but rather an invitation to order. By clicking the [Buy / Place Paid Order] button, you place a binding order. The purchase contract is concluded once we accept your order with an order confirmation via email. The booking becomes valid only after payment is received. The respective payment terms displayed during the booking process apply.

2.3 The customer must check the order confirmation and received tickets immediately upon receipt for correctness regarding quantity, price, date, time, event, and location. Claims must be made without delay (generally within five business days), or at least two business days before the ticket date for short-term bookings, in writing to info@magicbavaria.com.

2.4 The museum reserves the right to deny ticket purchases to individuals who disrupt the ticketing process or other guests or who violate the house rules or staff instructions.

3. Payment and Retention of Title

3.1 The following payment methods are available for online bookings:

• SEPA Direct Debit

• Credit Card (MasterCard/Visa)

• PayPal

3.2 Tickets remain the property of Magic Bavaria GmbH until full payment is received.

4. Admission Prices

4.1 Prices published online apply and include applicable VAT. Magic Bavaria reserves the right to set different prices on an individual basis, which will be indicated on the ticket.

4.2 Discounted tickets are available to eligible individuals/groups. Eligibility must be verified with a photo ID on the day of the visit. Improper use may lead to a surcharge or removal from the premises without a refund.

5. Redemption of Tickets

5.1 Tickets are valid only once for the specific date and venue listed.

​

5.2 Tickets are transferable. If the seller is also the organizer, redemption by the holder is valid unless the seller is aware (or grossly unaware) of the holder's ineligibility.

​

6. Redemption of Promotional Vouchers

6.1 Free promotional vouchers can only be redeemed online within the indicated period.

​

6.2 Specific items may be excluded from promotions.

​

6.3 Vouchers must be used before completing the order.

​

6.4 Only one promotional voucher can be used per order.

​

6.5 The order value must equal or exceed the voucher value. No credit will be issued for remaining balances.

​

6.6 If the voucher is insufficient, additional payment can be made using other available methods.

​

6.7 Promotional vouchers cannot be redeemed for cash or bear interest.

​

6.8 If items purchased with the voucher are returned, the voucher is not refunded.

​

6.9 Promotional vouchers are transferable under the same rules as tickets.

​

7. Redemption of Gift Vouchers

7.1 Gift vouchers can only be redeemed in the online shop unless otherwise stated.

7.2 Gift vouchers are valid until the end of the third year after the year of purchase.

​

7.3 Vouchers must be redeemed before checkout; no retroactive credit is possible.

​

7.4 Only one gift voucher can be used per order.

​

7.5 Gift vouchers may not be used to purchase other gift vouchers.

​

7.6 If the voucher does not cover the full amount, other payment methods may be used.

​

7.7 Gift vouchers are non-refundable and do not earn interest.

​

7.8 Vouchers are transferable under the same rules as tickets.

​

8. Right of Withdrawal and Ticket Replacement

8.1 Consumers generally have a right of withdrawal.

​

8.2 Details are provided in the seller’s withdrawal policy.

​

8.3 Per § 312g para. 2 no. 9 BGB, no withdrawal right exists for services related to leisure activities tied to specific dates, including ticket sales. Tickets cannot be returned or exchanged.

​

8.4 Lost or unused tickets (e.g., late arrivals or overcrowding) will not be refunded or replaced.

​

8.5 Temporary exhibition closures do not entitle visitors to a refund. Closures due to weather or events remain at the museum's discretion.

​

9. General Competition Conditions

9.1 The organizer of competitions on www.magicbavaria.com and on its Facebook/Instagram pages is Magic Bavaria GmbH, Munich. Competitions are not affiliated with Facebook or Instagram.

​

9.2 Participation requires compliance with these terms and the specific rules of each contest. Prizes are non-exchangeable and not payable in cash.

​

9.3 Participation is free and not tied to any purchase. Winners will be notified via email or messaging. Only residents of Germany aged 18+ may participate. Children need parental consent. Staff and relatives are excluded. Only one entry per person is allowed.

​

9.4 Breach of terms, especially manipulation, leads to exclusion. If a winner is excluded, the prize is forfeit. Prizes must be claimed within six weeks. Winners are responsible for tax liabilities.

​

9.5 Magic Bavaria may alter or cancel contests due to technical or legal reasons at any time.

​

9.6 Participants agree to the use of their personal data for the purpose of the contest. Winners agree to the public announcement of their name and location. Consent may be revoked at any time.

​

9.7 German law applies. Legal recourse is excluded.

​

10. Liability

Claims for damages are excluded unless caused by intent or gross negligence. This does not apply to personal injuries, items submitted for handling, or claims under product liability law.

11. Miscellaneous

Selling tickets privately on museum premises is prohibited. Visitors must follow house rules and show tickets on request. Violators may be removed without a refund.

​

12. Applicable Law and Jurisdiction

German law applies. For non-residents of Germany, the competent court is located in 80992 Munich.

​

13. Disclaimer

Magic Bavaria GmbH makes no guarantees regarding the accuracy or completeness of website information or linked pages. Content may be changed without notice.

14. Dispute Resolution / OS Platform

The EU Commission offers a platform for online dispute resolution (http://ec.europa.eu/consumers/odr/). Magic Bavaria GmbH does not participate in alternative dispute resolution procedures.

​

15. Severability Clause

If any provision is invalid, the remaining terms remain effective. Invalid provisions will be replaced by legally permissible alternatives.

​

16. Visitor and House Rules

• The house rules ensure a pleasant museum visit. By entering, visitors accept all rules.

• Visitors must follow the house rules.

• Opening times and prices are posted at the entrance. Tickets allow single entry and must be presented upon request.

• Admission is non-refundable once entered. Missed guided tours are not refunded.

• Food and drinks are only allowed in the designated café. Smoking is prohibited.

• Large bags, umbrellas, etc. must be left at the cloakroom. The museum is not liable for valuables.

• Children under 14 must be accompanied by an adult. Parents are responsible for their children.

• Animals (except guide dogs) are not allowed.

• Bicycles, scooters, etc., are prohibited.

• Exhibits must not be damaged; use is at one’s own risk.

• Premises must be kept clean.

• Teachers and group leaders are responsible for minors and damages caused.

• Instructions from staff must be followed. Violators may be removed without refund.

• All content is subject to German copyright law. Reproduction and use require prior written consent.
